WARRANTY POLICY

LivinCart and Services Private Limited, having its registered address at [ 3rd Floor, 30-15-35, Main Road, Saraswati Park, Daba Gardens, Visakhapatnam – 530020], India (“LivinCart”, “we”, “us”, or “our”), manages and operates the website/mobile application www.livincart.com (“LivinCart Platform”), through which it facilitates the sale of home furniture, décor items and 100+ interior services (“Products”) to users (“User”, “you”, “your”). By accepting the terms and conditions of this Warranty Policy (“Warranty Policy”), you agree that LivinCart provides a Warranty that the Products sold will be free from manufacturing defects in material, design, and workmanship (“Warranty”).


1. Warranty Period

1.1 The Warranty Period for each Product begins from the date of delivery to you. The applicable Warranty Period for every Product is displayed on the Product detail page along with its full description. This Warranty is non-transferable and applicable only to the original purchaser.

1.2 To be eligible for Warranty services, you must present a valid invoice whenever requested by LivinCart or its authorized representatives. Any unauthorized repairs, modifications, alterations, improper usage, or structural changes made to the Product after purchase will void the Warranty in full.


2. LivinCart Responsibilities

2.1 Subject to the Warranty conditions mentioned on the Product detail page and within the Warranty Period, LivinCart may, at its sole discretion, repair the defective Product, replace it with a new Product, or refund the purchase price.

2.2 In the case of repair, LivinCart will arrange for pickup of the defective Product from the original delivery address and return it after repairs. Upon your request, and at our discretion, the repaired Product may be delivered to an alternate address.

2.3 In the case of replacement, the replaced Product will be delivered to the original delivery address, and the defective Product will be collected simultaneously. Upon request, and at LivinCart’s discretion, replacement may be delivered to a different address.

2.4 Refunds, where applicable, will be processed only for prepaid orders and will be credited to the original mode of payment. Refunds will be initiated only after successful pickup and verification of the defective Product.


3. Exclusions

3.1 This Warranty does not apply to damages caused by improper installation, inadequate maintenance, mishandling, negligence, excessive loading, accidents, abuse, environmental factors, or use that is inconsistent with the Product instructions.

3.2 The Warranty does not cover natural wear and tear, colour or finish variations, natural wood characteristics, fabric pilling, or any aesthetic changes due to normal usage. LivinCart will determine, at its sole discretion, whether a defect qualifies for Warranty coverage.


4. Disclaimer

4.1 LivinCart shall not be liable for any incidental, consequential, indirect, or special damages, including loss of profits, loss of business, or any other financial loss. The Warranty does not extend to personal injury or death caused by negligence or improper handling by the User.

4.2 Minor imperfections that are within acceptable industry standards or variations that do not materially affect the usage of the Product are not considered defects. Differences between images displayed on the Platform and the actual Product due to lighting or digital display variations shall not qualify for Warranty claims.

4.3 LivinCart shall have the sole authority to determine whether a Product is defective and whether it qualifies for repair, replacement, or refund. LivinCart reserves the right to charge for inspection, transportation, and service costs where applicable.

4.4 If a third party or manufacturer provides its own warranty for a Product, such warranty shall be enforced solely between you and the third party. LivinCart shall not be responsible for such third-party warranties.


5. Governing Law & Jurisdiction

5.1 This Warranty Policy shall be governed by the laws of India. Any disputes arising from or relating to this Warranty Policy shall be subject to the exclusive jurisdiction of the courts located in [Visakhapatnam], India.


6. Amendment

6.1 LivinCart reserves the right to amend, modify, or update the terms of this Warranty Policy at any time due to changes in Product availability, services, spare parts, or legal and regulatory obligations.
